Terms of Service
Version 2026-11-07.3 · Last updated: November 7, 2026
These terms govern the use of Kubo CRM, the website at app.kubocrm.com and the mobile app (the “service”), provided by RETAIL ONLINE LLC, 2201 Menaul Blvd NE Ste A, Albuquerque, NM 87107, United States (“Kubo CRM”, “we”). They apply to the company that opens an account (the “customer”) and to the people it gives access to (the “users”) from the moment the customer accepts them, together with the Data Processing Agreement, which forms part of them and which customers can read in the application once signed in, or request at privacy@kubocrm.com before opening an account. We ask for that acceptance expressly in the application: with a checkbox when a company’s account is created and, for companies that already had an account, with a one-time acceptance by their owner. We keep a record of the version accepted, the date, and the IP address and browser from which it was accepted (see the Privacy Policy).
1. The service
Kubo CRM is software for managing leads: it lets a company receive leads from its forms and from other services it connects, import them from files, organize them by status, assign them to its team and keep a record of what is done with them.
We may improve, change or remove features. If we remove an essential feature, we will let the customer know in advance.
2. Accounts and security
- Kubo CRM is designed for companies and professionals. The person who creates an account declares that they are authorized to accept these terms on behalf of the customer.
- The customer’s owner and the users it authorizes can add users, give them roles and permissions, deactivate them and require two-step verification. The customer is responsible for whom it gives access to and for what its users do in its account.
- Each user must keep their password confidential, must not share their account and must let us know at info@kubocrm.com as soon as they suspect unauthorized access.
3. Acceptable use
The customer and its users must not:
- process personal data in breach of data protection law, or use the service for communications that the law does not allow;
- store unlawful content or content that infringes the rights of others;
- store special categories of personal data (such as health data) unless the law allows it and the customer has assessed it;
- try to access other customers’ data, test the security of the service without our written permission, or interfere with its operation;
- overload the service, for example with automated mass requests outside the documented integrations;
- copy, resell or reverse engineer the service, except where the law allows it.
If the customer or its users break these rules, we may suspend access as described in Suspension and termination.
4. The customer’s data
- The data the customer stores in Kubo CRM, including its leads, belongs to the customer. We process it only to provide the service, under the Data Processing Agreement.
- The customer is responsible for having a legal basis to process its leads’ data and for informing them, for example in the privacy notice of its own forms.
- The users with the export permission can export the customer’s leads in CSV format at any time.
- We process users’ account data as controller, as explained in our Privacy Policy.
5. Integrations
Kubo CRM can receive leads from other services, such as websites, forms, booking tools, Google Ads lead forms and WordPress plugins, and the emails the customer forwards to its own Kubo CRM address, and it can send notices to messaging tools such as Slack, Microsoft Teams or Telegram and, on the Pro plan, send each new lead and each status change to an address the customer chooses (the outgoing webhook). The customer chooses which services to connect, and its use of them is governed by their own terms. We are not responsible for the availability of third-party services or for their changes.
Notices are sent to the destination the customer chooses, with the data it chooses, and anyone with access to that destination can read them. The outgoing webhook sends all of the lead’s data, signed, to the address the customer chooses, and what is sent there is governed by the terms of that destination.
The secret address or key of the integrations that have one, such as the webhook, the incoming email address, the key of the Google Ads lead forms or the signing secret of the outgoing webhook, must be kept confidential, and the customer can replace it at any time. The address of the Kubo CRM form for websites is public, because it goes in the website’s code, and is protected by other means, such as limits on submissions.
6. Plans and prices
Today Kubo CRM charges nothing: paid plans cannot yet be bought from the application, and we hold no payment details.
Each company has a plan: Free, Team or Pro. Each plan includes a number of active users, of new leads a month, of integrations and of new leads per imported file, and some features (changing the permissions of each role; reading the activity log; letting rules set the source, the status, the person in charge or the tags; the notice of unattended leads; and the outgoing webhook), as shown in the application, in Configuración → Plan (Settings → Plan). Leads that are imported, or that are added to a lead that is already open, do not count as new leads of the month, and neither notices to Slack, Teams or Telegram nor the outgoing webhook count as integrations.
On the Free plan, once that month’s new leads have come in, new leads can no longer be created by hand, and what arrives through an integration is kept, without being shown to anyone (500 entries at most), and becomes a lead when the next month starts (in order of arrival, as many as fit in that month’s new leads) or when the plan is upgraded, unless the rules in place at that time ignore it; its entry keeps the date it arrived. What arrives with 500 already waiting is not kept: only who sent it, its subject and the decision are logged, for 30 days. Meanwhile, the company can see how many are waiting, and its owner can discard them at any time.
If a company has more than its plan includes (for example, after moving to a lower plan), what it already has keeps working: it just cannot add more until it is back within the limit or upgrades the plan.
Before we charge for anything, we will publish here the prices, how payment and renewal work and the cancellation and refund terms, and the customer will have to accept them expressly. Nobody will be charged without that acceptance. If we lower what a plan includes, we will announce it in advance.
7. Availability and support
We work to keep Kubo CRM available and secure, but we do not guarantee that it will be uninterrupted or error-free. There may be interruptions for maintenance, updates or causes beyond our control, such as failures of our providers. We do not offer a service level agreement.
We provide support by email at info@kubocrm.com, without guaranteed response times.
We recommend that the customer regularly export the data it needs, to keep its own copy.
8. Intellectual property
Kubo CRM, its code, its design and its brand belong to us or are used under license. While its account is active, we grant the customer a non-exclusive, non-transferable right to use the service for its own business under these terms. The customer keeps all rights to its data.
9. Limitation of liability
The service is provided “as is”. To the extent permitted by law, we are not liable for indirect damages, loss of profits, loss of business or loss of data resulting from the use of the service or the inability to use it.
Our total liability to the customer for any claim related to the service is limited to the greater of the amounts the customer has paid us for the service in the twelve months before the event giving rise to the claim and 100 U.S. dollars (USD 100).
These limits do not apply where the law does not allow liability to be limited, such as in cases of fraud, willful misconduct, gross negligence, death or personal injury, and they do not limit the rights of consumers or the liability that data protection law imposes on each party.
10. Suspension and termination
- The customer may stop using Kubo CRM at any time. To close its account and delete its data, the owner writes to privacy@kubocrm.com from the account’s email address. Before doing so, it can export its leads. We will delete the account and its data within 30 days of the request, as set out in the Data Processing Agreement.
- We may suspend or close an account that breaches these terms after notifying the customer and giving it a reasonable period to remedy the breach, unless the breach is serious or puts the security of the service or of other customers at risk; in that case we may act immediately and will inform the customer.
- If we decide to stop providing Kubo CRM, we will let customers know at least 30 days in advance so that they can export their data.
11. Governing law and courts
These terms are governed by the laws of the State of New Mexico (United States), where we are based, and the courts of New Mexico have jurisdiction over any dispute. If you are a consumer, you retain the protection afforded to you by the law of your country of residence, you may also bring a claim before the courts where you live, and you may be sued only in those courts. What the Data Processing Agreement provides for the standard contractual clauses also applies.
12. Changes to these terms
We may change these terms. We will publish the new version here with its date and, if the change is significant, we will notify the customer’s owner by email at least 30 days before it applies. If the customer does not agree, it may close its account before the change applies.
